Man accused of stealing soda from McDonalds arrested again at Pizza Hut

A Naples man who made headlines last month when he was arrested and accused of stealing a $1 soda refill from McDonalds was arrested again Monday outside a local Pizza Hut.

Mark Francis Abaire, 52, who authorities said is homeless, faces a misdemeanor trespassing charge.

An arrest report from the Collier County Sheriff's Offices gives this account:

Around 3:30 a.m., a sheriff's deputy was patrolling an area around the Pizza Hut at 3010 U.S. 41 East when he saw a "shadowy figure" emerge from the bushes and begin running toward the restaurant.

Recognizing the man from "many law enforcement encounters," the deputy stopped his patrol car to speak with Abaire, whom he had arrested in February at the same Pizza Hut. On that occasion, Abaire was accused of open container violations and trespassing, and he was told by the manager not to return.

When asked what he was doing at the business, which was not open at 3:30 a.m., Abaire told the deputy, "I dropped my lighter."

When asked why he was standing in front of the front door, he said, "I picked up my lighter."

As of Tuesday, Abaire remained at the Naples Jail Center waiting for bond to be set. His notices of trespassing at the Pizza Hut date back to at least June of 2009, according to arrest records.

This man has 41 arrests not including those from 1988 to 2002 which resulted in 4 trips to State Prison. Granted most are misdemeanors but this revolving door needs to stop somewhere for the taxpayers-does he just get arrested for a meal and a place to sleep? If the Judicial system cannot do something with him (Habitual Offender) it would be cheaper for us to pitch in a few dollars and give him a non refundable bus ticket out of the State of Florida-like to Arizona. Eventually somewhere down the line he should be given what he wants for breaking the law almost every month-life in Prison.

CCSO has a prisoner van which usually runs weekly to Miami-Dade. Just put Mark in the van and drop him off somewhere downtown. Works for unwanted dogs. He can't (won't) follow the rules at St. Matthews, so he's Persona non grata. Maybe you can take the poor guy in.

Again, see post #1. You feel bad for the guy? Track him and down and help him out yourself. He should not be too hard to find, try Pizza Hut or McDonald's.

This guy isnt going anywhere. They will give him a bond on this new arrest, but revoke the bond on the soda theft arrest, hence he will be sitting in the jail until these matters are resolved.

I only took one up on it, and only because he was in a very rough area of town, and likely would not have made it through the night. Your job is to "protect and serve", which is what I was doing.

Of course you tree huggers want St Mathews to take responsibility for this dreg of society and also blame the deputies for feeling no compassion. Please feel free to move him into your 2/2 rental so he can feel loved and help you out around the house by stealing all of your crap. This loser has chosen his path in life; he also chooses to not play by the rules and not get along with others. I feel about as much sympathy for him as that fugly octomom or those skanky Kardasian hookers.
